These Terms of Service (the “Terms”) form a legally binding agreement between you and Landing Dates, operated by Miguel Dominguez, an individual operating from Poland (the “Operator,” “Landing Dates,” “we,” “us,” or “our”).

These Terms govern your access to and use of www.landingdates.com and the related services we offer through the website (collectively, the “Service”).

By using the Service, placing an order, or uploading photos, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Service.

1. Our Service

Landing Dates is an AI-powered dating photo service. Users upload photographs and receive AI-generated dating profile images designed to improve the visual quality of their dating profiles on services such as Tinder, Bumble, Hinge, and similar platforms.

The Service is private by default. Users do not currently need to create an account. Orders are processed through the website and generated images are delivered privately, typically by email.

The Service relies on third-party providers, including:

• Stripe for payment processing
• Supabase for storage and order management
• Google Cloud / Vertex AI, including Gemini / Imagen services, for AI image generation

2. Eligibility

The Service is intended only for users who are at least 18 years old.

By using the Service, you represent and warrant that:

• you are at least 18 years old;
• you have the legal capacity to enter into these Terms;
• you will use the Service only for lawful purposes; and
• your use of the Service will not violate any applicable law or third-party rights.

3. Orders, Purchases, and Payment

The Service is currently offered on a one-time payment basis unless we state otherwise on the website.

You agree to provide current, complete, and accurate information for your order, including your name, email address, and payment details where required. We may refuse, limit, or cancel any order where we reasonably believe:

• the order violates these Terms;
• the uploaded content is prohibited, unlawful, or non-consensual;
• payment cannot be completed;
• the information provided is inaccurate or incomplete; or
• we are unable to fulfill the order for operational or legal reasons.

Payments are processed through Stripe. We do not store your full payment card details.

4. Refunds

Because the Service involves personalized digital content created from photos you submit, all sales are generally final once processing has begun, except where:

• a refund is required by applicable law;
• we state otherwise on the website or in a separate refund policy; or
• we choose to issue a refund in our discretion.

If you are a consumer in the EU, EEA, or UK, your statutory rights may still apply. We may ask you to confirm that performance of the personalized digital service should begin immediately after purchase.

5. User Photos and Content

You retain ownership of the photographs and other materials you submit through the Service (“User Content”).

By submitting User Content, you represent, warrant, and agree that:

• you are the person shown in the photos, or you have that person’s explicit permission to submit the photos and request the Service on their behalf;
• you have all rights, permissions, and consents necessary to submit the photos and allow us to process them;
• the photos do not depict minors;
• the photos do not contain illegal, exploitative, sexually explicit, hateful, violent, or otherwise prohibited material; and
• your User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party.

You grant us a limited, non-exclusive, royalty-free license to host, store, copy, transmit, and process your User Content solely as necessary to provide the Service, comply with law, enforce these Terms, and maintain the security and operation of the Service.

We do not claim ownership of your original uploaded photos.

6. Generated Images

Subject to your compliance with these Terms, you may use the AI-generated images created for your order (“Generated Images”) for your personal, lawful purposes.

You acknowledge that:

• AI-generated images may not always be accurate, realistic, or suitable for your intended purpose;
• results may vary depending on the quality and content of the uploaded photos;
• Generated Images may not be unique; and
• AI-generated images may not be eligible for copyright protection in all jurisdictions.

Unless we separately agree otherwise in writing, we do not use your Generated Images for marketing or promotional purposes.

7. Prohibited Uses

You may not use the Service to:

• upload photos of another person without proper authorization;
• create misleading, deceptive, defamatory, or impersonation-based images;
• create non-consensual deepfake-style content;
• upload or generate content involving minors;
• upload or generate illegal, abusive, hateful, sexually explicit, or exploitative content;
• infringe any intellectual property, privacy, publicity, or other legal rights;
• use the Service or Generated Images for fraud, identity theft, or unlawful activity;
• use the Service to train, fine-tune, benchmark, or improve any AI or machine-learning model without our prior written consent;
• interfere with, disrupt, scrape, or attempt unauthorized access to the Service.

We may suspend or terminate access, cancel orders, remove content, or report unlawful conduct where we reasonably consider it necessary.

8. Intellectual Property

Except for your User Content and any rights granted to you in the Generated Images under these Terms, all rights in the website, Service, branding, text, design, software, workflows, and other materials remain ours or our licensors’.

If you send us comments, suggestions, or feedback, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use that feedback for any lawful purpose without compensation to you.

9. Third-Party Services

The Service depends on third-party providers. Your use of those third-party services may also be governed by their own terms and privacy policies.

We are not responsible for the acts, omissions, or policies of third-party providers, including payment processors or infrastructure providers, except to the extent required by applicable law.

10. Privacy

Our Privacy Policy explains how we collect, use, store, and share personal data in connection with the Service. By using the Service, you also acknowledge our Privacy Policy.

We currently intend to delete uploaded photos, Generated Images, and our service-held order records within 30 days, subject to legal, security, fraud-prevention, backup, and dispute-resolution needs.

We do not use your photos or Generated Images to train our own AI models.

11. Disclaimer

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or accuracy.

We do not guarantee that:

• the Service will always be uninterrupted, secure, or error-free;
• the Generated Images will meet your expectations;
• the Generated Images will be unique;
• the Service will always be available or delivered within a particular timeframe unless we expressly state otherwise.

12. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the Service.

To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service or these Terms will not exceed the amount you paid us for the specific order giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Landing Dates and the Operator from claims, liabilities, damages, losses, and expenses arising out of or relating to:

• your User Content;
• your use of the Service or Generated Images;
• your breach of these Terms; or
• your violation of any law or third-party right.

14. Termination

We may suspend, restrict, or terminate your access to the Service at any time where we reasonably believe it is necessary to protect the Service, enforce these Terms, investigate abuse, or comply with applicable law.

15. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts in Krakow, Poland, unless mandatory consumer protection law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. If we do, we will post the updated version on the website and update the Effective Date above. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.
